When another firm should be in the case.
This office actively works with other firms. That includes medical malpractice, birth-injury cases, and death cases.
A birth injury or a death case is often tried with another firm that already handles that work. Both firms are in the written fee. The client signs one contract, not two. The case is not taken until this office reviews the file and signs.
There is no legal requirement that a lawyer charge a set contingency percentage. The client may bargain the rate. This office will ask other counsel to accept a lower percentage than that firm’s usual rate.
On a personal-injury, property-damage, or wrongful-death contingency matter, the lawyers divide one fee. The firm with primary responsibility receives at least 75 percent of that fee. The firm with secondary responsibility receives at most 25 percent, unless the firms share the work about equally and a court approves another split.
The client and every firm sign the contract before the fee is divided. Each firm assumes joint responsibility. The client receives the Statement of Client’s Rights.
The savings are that lower percentage. This office does not pay the client a portion of its fee.
